The Supreme Court has transferred the investigation into alleged irregularities in additional compensation paid to farmers following land acquisition in Noida to the Uttar Pradesh Vigilance Department.

The Court directed the Vigilance Department to take over the investigation from the Special Investigation Team and complete the probe within a maximum period of three months.

The Court also clarified that the accused will not be arrested at present and that the existing stay on arrests will continue during this period.

Additional Land Compensation Under Investigation

The case concerns alleged irregularities in the payment of additional compensation by the Noida Authority after acquiring agricultural land.

The investigation reportedly covers the role of officials ranging from the former legal officer of the authority to senior officers at the level of the Chief Executive Officer.

Compensation-related matters involving land situated in the following villages are under examination:

  • Gejha Tilpatabad
  • Nagla Charandas
  • Bhuda

Investigators are examining whether additional compensation was approved and released in accordance with the applicable procedures.

Six FIRs Registered in the Case

The earlier SIT investigation revealed that six FIRs had been registered in connection with the alleged irregularities.

According to the SIT report:

  • Three FIRs relate to allegations that a 10% commission was collected for facilitating additional compensation payments.
  • Three FIRs involve allegations of disproportionate assets against certain officials.

The financial records, properties and sources of income of the officials concerned are being examined as part of these cases.

Around 160 Farmers Questioned

During its investigation, the SIT recorded statements from approximately 160 farmers.

The investigation included examination of:

  • Compensation files
  • Land acquisition records
  • Revenue documents
  • Noida Authority files
  • Payment approvals
  • Roles of concerned officials
  • Statements of beneficiaries

The Vigilance Department will now review these statements and the documentary evidence already collected by the SIT.

Alleged Irregularities Date Back to 2015

According to sources associated with the Noida Authority, the alleged irregularities date back to 2015.

It has been alleged that some individuals may have received improper benefits because established procedures were not followed while approving or distributing additional compensation.

The matter has reportedly already been examined through:

  • Three SIT investigations
  • One internal inquiry conducted by the Noida Authority

The latest Supreme Court direction places responsibility for completing the investigation on the state Vigilance Department.

Alleged 10% Commission Network Under Scanner

One of the principal allegations concerns an alleged commission system under which intermediaries or officials reportedly demanded 10% of the additional compensation amount for facilitating payments to farmers.

The Vigilance Department is expected to examine:

  • Persons who allegedly demanded commissions
  • Officials who processed compensation claims
  • Banking transactions
  • Cash movements
  • Property purchases
  • Possible intermediary networks
  • Links between officials and beneficiaries

Investigators will seek to determine whether any organised mechanism was used to extract illegal payments.

Disproportionate Assets Cases Being Examined

Three of the six FIRs reportedly concern allegations that certain officials possessed assets disproportionate to their known sources of income.

The Vigilance investigation may review:

  • Salary and income records
  • Bank accounts
  • Immovable properties
  • Investments
  • Family-linked assets
  • High-value purchases
  • Financial transactions during the relevant period

Any mismatch between lawful income and accumulated assets would require detailed explanation and supporting records.

Role of Noida Authority Officials Under Review

The probe will focus on identifying the role of officials and employees involved in:

  • Examining compensation claims
  • Providing legal opinions
  • Approving additional payments
  • Processing financial sanctions
  • Maintaining land records
  • Authorising fund releases

Investigators will assess whether established procedures were deliberately bypassed or whether administrative failures contributed to the alleged irregularities.

Vigilance to Review SIT Findings

The Uttar Pradesh Vigilance Department will now take custody of:

  • SIT investigation reports
  • Six registered FIRs
  • Statements of approximately 160 farmers
  • Land acquisition documents
  • Compensation calculation records
  • Internal authority files
  • Banking and property information
  • Other supporting evidence

The department may conduct further questioning or collect additional evidence wherever necessary.

No Arrests at Present

The Supreme Court has maintained the existing protection against arrest.

This means that no accused person will be arrested at the current stage while the Vigilance Department completes the court-directed investigation.

However, the protection from arrest does not amount to a finding regarding the merits of the allegations or the innocence of any person.

Further action will depend on the findings recorded in the Vigilance report and subsequent judicial directions.

Three-Month Deadline for Completion

The Supreme Court has directed that the investigation be completed within a maximum period of three months.

Within this period, the Vigilance Department is expected to:

  • Review the earlier investigation
  • Verify documentary evidence
  • Examine financial transactions
  • Determine individual responsibility
  • Identify procedural violations
  • Submit its findings

Any new evidence or involvement of additional individuals may lead to further legal proceedings.

Why Land Compensation Cases Require Detailed Audits

Large land compensation investigations often require examination of several interconnected records, including:

  • Original ownership documents
  • Land acquisition notifications
  • Compensation calculations
  • Court orders
  • Revenue records
  • Bank payment details
  • Internal approval files
  • Property and asset records

A clear audit trail is necessary to determine whether additional compensation was legally payable and whether any official or intermediary received an unlawful benefit.

Conclusion

The Supreme Court’s decision to transfer the Noida compensation scam investigation to the Uttar Pradesh Vigilance Department marks a significant development in the long-running case.

The Vigilance Department must complete its investigation within three months, while the protection from arrest will continue for the time being.

The allegations remain under investigation, and any determination of wrongdoing or criminal liability will depend on the evidence collected and examined through the legal process.

Shunyatax Global Insight

Shunyatax Global says that land acquisition compensation involves substantial public funds and must be supported by transparent calculations, independent legal verification and multi-level approvals.

Authorities should digitally link land ownership records, compensation orders, beneficiary bank accounts and approval files so that every payment can be traced from sanction to receipt. Any recurring commission pattern, unusual asset growth or deviation from approved procedures should automatically trigger a forensic audit.
